GUJCOCA held unconstitutional by the Union Government Gujarat Control of Organised Crime Act (GUJCOCA) was withheld by the Union Government as the “ present mind of the parliament and the constitution” does not approve some of the provisions in the Act. “ The parliament no longer approves a confession before a police officer” Union Minister for Home Affairs said. He added that the " Parliament no longer approves that a person should be held without bail and without charge sheet for a longer period than the period stipulated in the CrPC". The bill was adopted by Gujarat assembly in June 2009 rejecting the three amendments recommended by the President. The Bill was originally passed in 2004 but was sent back for reconsideration by President A P J Abdul Kalam. “Acts of terrorism “ in the original bill was replaced by “organized crime”.
